The importance of having a Health Care Surrogate Designation

The subject of my blog today is on the importance of having a good Healthcare Surrogate Designation (HCS) as part of your estate planning. A good HCS will allow you to appoint someone to make healthcare decisions for you if you are ever not able to make them for yourself. Many times I have a client come in that only wants a Last Will and Testament prepared. I feel it is my duty to my clients to counsel them on the importance of having a HCS in place should they ever need it. It is important that the client chooses someone, either family member or friend, that is close to them in proximity to them as this will be the person taking you to routine medical appointments if you need them to. Many times clients want to name a child that lives across the country. This is usually not a good idea since they are so far away. This person will be the one tasked with making all of your heathcare decisions if you are not able to make them for yourself.

I tell my clients that they should appoint not only a primary person to serve, but should also list a backup person to serve if the primary person is unable to. The advantage of doing this is that if you do not have this HCS and become incapacitated then your family will have to ask the Court to appoint a guardian for you. This is not only expensive, but is also very stressful for your family at a time when additional stress does not need to be added. By planning ahead you can save your family alot of stress and money.
